The following terms and disclaimer apply for users of the app. Please see the respective Terms of Use for any

You may not reproduce content from this app for commercial purposes. You acknowledge that by importing any content
to your own device, you accept responsibility for doing so and are allowed to access this content.
The contents of this app are made available solely for your exclusive personal, non-commercial, and educational
use and should not be relied upon to diagnose or treat patients. The contents are made available to you for
general medical education purposes.
Any external websites you visit through the app's internal web browser are accessed at your own risk. You

Subscriptions and all forms of payments and receipts are handled through your respective device's app store (Apple
App Store or Google Play Store). Any refunds or receipts must be handled through this process. You must abide by
App Store and Google Play Store policy.
All billing information or payment information is handled through your device's respective app store (Apple App
Store or Google Play Store). Search on Shift and its developer(s) do not have access to, nor want access to, this
information. The only information available is the standard information given to developers for billing and refund
purposes through the App Store and Google Play Store.
Pricing and taxes are based on US dollars (USD), which may be automatically converted to other currencies by your
device's app store. Prices do not include applicable sales taxes, which may be displayed or added during the
checkout process depending on the app store's policy.
User Notes and Content: You retain all ownership rights to any content you save within the app. If you would like
to share suggestions or notes, you may do so freely.
Service interruptions: Though rare, there may be limitations in accessing the content of the app due to service
outages or other issues. We will attempt to avoid this, but in any case, Search on Shift and its developer(s)
shall not be held liable for any losses or damages, direct or
indirect, pecuniary or non-pecuniary, resulting from the interruption of the normal functioning of the services,
and disclaims any responsibility thereto.
Indemnity: Notwithstanding any other term of the Terms of Use or any act or failure to act by Search on Shift or
its representatives, you agree to indemnify, defend and hold harmless Search on Shift and its representatives from
and against any damages, liabilities, costs and expenses (including attorneys’ fees),
claims or demands, arising out of (i) your use of or connection to the Services or the information thereon or
information streamed or downloaded therefrom (including but not limited to Search on Shift content); (ii) your
participation in any activities arising from the Services or the information thereon or information streamed or
downloaded therefrom (including but not limited to Search on Shift content); (iii) your violation of, or failure
to perform
your obligations under the terms of use or the Privacy Policy; or (iv) your violation of any rights of a third
party.

1. Acknowledgement: (Based on Apple's standard EULA) Search on Shift, its representatives, and you
acknowledge that this EULA is concluded between these parties only, and not with Apple, and Search on Shift and
its representatives, not Apple, are solely responsible for the Licensed Application and the
content thereof. The terms of this agreement do not include usage rules for the app that are in conflict with, the
Apple Media Services Terms and Conditions as of the Effective Date, and these terms have been reviewed by Search
on Shift and its representatives.
2. Scope of License: (Based on Apple's standard EULA) The license granted to you for the app is limited to
a
non-transferable license to use the app on any Apple-branded Products that you own or
control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except
that such app may be accessed and used by other accounts associated with the purchaser via Family
Sharing or volume purchasing, as indicated.
3. Maintenance and Support: (Based on Apple's standard EULA) Apple is not responsible for providing
maintenance and support
services with respect to the app, as specified in the EULA (terms of use), or as required under applicable law.
Search on Shift, its representatives, and you acknowledge that Apple has no obligation whatsoever to furnish any
maintenance and
support services with respect to the Licensed Application.
4. Warranty: (Based on Apple's standard EULA) Apple is not responsible for any product warranties, whether
express or implied by law,
to the extent not effectively disclaimed. In the event of any failure of the app to conform to any applicable
warranty, you may notify Apple, and Apple will refund the
purchase price for the app to you; and to the maximum extent permitted by
applicable law, Apple will have no other warranty obligation whatsoever with respect to the app,
and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to
any warranty are not Apple's responsibility.
5. Product Claims: (Based on Apple's standard EULA) Search on Shift, its representatives, and you
acknowledge that Apple is not responsible for
addressing any claims of the End-User or any third party relating to the app or the end- user’s
possession and/or use of that app, including, but not limited to: (i) product liability claims;
(ii) any claim that the app fails to conform to any applicable legal or regulatory requirement;
and (iii) claims arising under consumer protection, privacy, or similar legislation.
6. Intellectual Property Rights: (Based on Apple's standard EULA) Search on Shift, its representatives, and
you acknowledge that, in the event of any third
party claim that the app or your possession and use of that app
infringes that third party’s intellectual property rights, Apple is not responsible for the
investigation, defense, settlement and discharge of any such intellectual property infringement claim.
7. Legal Compliance: (Based on Apple's standard EULA) You must represent and warrant that (i)
you are not located in a country
that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist
supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted
parties.

acknowledge and
agree that Apple, and Apple’s
subsidiaries, are third party beneficiaries of the EULA, and that, upon your acceptance of the terms and
conditions of the EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce the
EULA against you as a third party beneficiary thereof.
